Wow US Attorney Patrick Fitzgerald says you're guilty of something and we don't even have to have a trial. Man the kangaroos are jumping in Illinois. Dissenting Justice Darren Hutchinson says NO WAY. At least he believes there ought to be a trial.

Hi, thanks for the cite. I expected to see more discussion of this from the crim law bar....Hopefully, people are just easing back into things from the holidays, rather than not having anything to say about the subject.

I think the politics of the situation has kept some people from blogging this. I am suprised by TalkLeft and some of the other Political/Crim law blogs not taking on Fitzgerald and his holier than thou indictment. Here again is a federal prosecutor going about undoing an election result based on thoughts and plans. Plans I am not sure actually violate the law and are really just politics as usual.

Fitzgerald's problem is Ed Genson is not Ted Wells. He will fight him the way he needs to be fought. Anyone who thinks this is a slam dunk for the government now that Genson is on the team is nuts. The judge better be ready for the barroom brawl this one is going to be.

As for Burris, the Dem Senate ought to be ashamed of itself. He ought to be seated by Inauguration day.
